Acknowledgement of Risk

Ocean Blue Fishing Adventures is a booking agent for companies that provide adventures to the public. Ocean Blue Fishing Adventures is not the provider of these adventures.

The Participant acknowledges and agrees that, upon booking an adventure through Ocean Blue Fishing Adventures, all Participants have read and agree to this Acknowledgement of Risk, wherein the Participant(s) release(s) Ocean Blue Fishing Adventures from any liability with respect to any injuries, loss or damages which may be sustained by the Participant(s) in the course of undertaking any fishing adventure, whether dangerous, hazardous or otherwise.

The Participant(s) unconditionally agree to fully indemnify Ocean Blue Fishing Adventures and all its servants, agents, clients and employees against any injury, damage or accident that may be sustained by the Participant(s), whilst participating in adventures booked through Ocean Blue Fishing Adventures or the Entities and Groups who offer various services to Ocean Blue Fishing Adventures. These conditions also apply to adventures won as prizes.

Ocean Blue Fishing Adventures and its fishing operators reserve the right to cancel an adventure at any time in the event of adverse weather conditions, equipment failure or other reasonable and unforeseen circumstances. In such an event, an alternative date will be arranged with the Participant(s).

Trip itineraries and activities are a guide only and may be subject to change, Ocean Blue Fishing Adventures and its fishing operators reserve the right to amend an itinerary due to adverse weather conditions or any other circumstances.

Certain group adventures require minimum participant numbers for the adventure to take place. If minimum numbers are not met, or if other participants booked onto a certain adventure withdraw from the adventure, additional costs may need to be covered by the remaining anglers for the trip to proceed. If in the event of cancellation Ocean Blue Fishing Adventures or its adventure operator will contact you to arrange an alternative date.

Ocean Blue Fishing Adventures will not be responsible for any loss, injury or damage incurred or suffered by the participant during the fishing adventure, or in the event the adventure is cancelled or postponed for any reason whatsoever.

The Participant warrants that he/she does not suffer from any Medical Condition and/or incapacity which may impair the Participants ability to participate in Ocean Blue Fishing Adventures’ adventures and further, that the Participant does not suffer from any Heart Condition, Epilepsy or other Medical Condition which may result in the Participant potentially placing himself/herself in a position of risk, by undertaking adventures booked through Ocean Blue Fishing Adventures.

The Participant pledges that no legal action will be initiated by it against Ocean Blue Fishing Adventures, its clients, its agents, employees, instructors, and/or personnel, due to any accident or injury sustained during the course of undertaking an adventure booked through Ocean Blue Fishing Adventures.

Booking Desposits

For bookings made in excess of 60 days prior to departure date, a 20% non refundable deposit per person is due within 14 days of the booking confirmation. The balance is payable 60 days prior to the departure date. For bookings made less than 60 days prior to the departure date, full payment is required at time of booking.

A late booking fee of $25 per file in addition to the full payment will apply for bookings made within 7 days of the departure date.

Booking Cancellations

Changing or canceling your booking at any time will incur a loss of your 20% non refundable deposit. Changes will incur a $110 administration fee, plus any relevant fees from the fishing operator. Cancellations or changes to your booking require a minimum of 30 days written notice prior to the booked date. A $25 fee will apply to any credit card chargebacks. If you fail to show at the booked time, or on the booked day of your fishing adventure we cannot offer a refund or credit.

Price Changes

Fluctuations in economic conditions, exchange rates, natural disasters or any other unforeseen events outside the control of Ocean Blue Fishing Adventures may cause price increases in the various adventure packages available. Ocean Blue Fishing Adventures will endeavour to maintain prices at the level at which they were quoted and/or booked, but reserve the right to adjust prices up to the departure date if unforeseen circumstances arise. Any such price adjustment will be notified to the traveller and must be paid in full before departure.

Refunds

When the Participant(s) cancel(s) a booking, any refund will not include the 20% non refundable deposit component applicable to all charters. A refund is not available for any cancellations made after the departure date or in respect of any accommodation, meals, tours or any other services that are not utilised. In addition, no hotel, ground operator or airline is authorised to make representations or offer refunds on behalf of Ocean Blue Fishing Adventures without our prior authority.

Adventures or part thereof which are cancelled due to bad weather or unforeseen circumstances out of the control of Ocean Blue Fishing Adventures will not be eligible for a refund. Most events which cause distress to travellers can be insured against and we strongly advise the purchase of a suitable travel insurance policy. (See below).

Ocean Blue Fishing Adventures strongly advises purchasing travel insurance to protect against loss caused by overseas medical & hospital expenses, stolen & lost luggage, trip and activity cancellations, flight delays, evacuation and more.
